This Privacy Policy explains how Brackwell9 LLC (“Brackwell9,” “we,” “us,” or “our”) collects, uses, and discloses information about you when you visit brackwell9.com (the “Site”), contact us, engage us for custom software development, or use any software-as-a-service products we offer (collectively, the “Services”). It also describes the choices and rights you have regarding your information.
By using the Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Services.
1. Information We Collect
1.1 Information you provide directly
We collect information you provide when you:
- Contact us through the Site contact form, by email, or otherwise — including your name, email address, the subject of your inquiry, and the contents of your message.
- Engage us for services — including business contact details, billing and payment information, project requirements, and any other materials you share with us in connection with an engagement.
- Create an account or use a SaaS product we operate — including account credentials, profile information, and any content you submit through the product.
1.2 Information collected automatically
When you visit the Site, we and our service providers may automatically collect:
- Log and device data — IP address, browser type and version, operating system, referring page, and the pages you view.
- Usage data — aggregated, pseudonymized analytics about how visitors interact with the Site, collected through Vercel Web Analytics. Vercel Web Analytics does not use cookies and does not track individuals across sites.
The Site does not currently set advertising cookies, sell personal information, or share personal information for cross-context behavioral advertising. If that changes, we will update this Policy and provide the disclosures and choices required by law.
1.3 Information from third parties
We may receive information about you from business partners, service providers, or publicly available sources, for example to verify a company you represent, to evaluate a prospective engagement, or to deliver email you have sent us.
2. How We Use Information
We use the information we collect to:
- respond to inquiries and provide information you request;
- negotiate, enter into, and perform engagements with clients;
- operate, secure, and improve the Site and any SaaS products we offer;
- send transactional communications (e.g., service updates, security notices, invoices);
- understand how the Site is used and improve its content and design;
- comply with legal obligations and enforce our terms, policies, and agreements; and
- with your consent or as otherwise permitted by law, send you marketing communications you can unsubscribe from at any time.
3. How We Share Information
We do not sell your personal information. We share information only in the following circumstances:
- Service providers and subprocessors. We share information with vendors that
perform services on our behalf, under contractual obligations to keep it confidential and use
it only for the services we engage them to provide. Current subprocessors include:
- Vercel — hosting and Site analytics;
- Resend — transactional email delivery; and
- Google Workspace — email and productivity tools used to receive and respond to your messages.
- Clients and project parties. If you contact us in connection with a project we are performing for a client, we may share your information with that client as reasonably necessary.
- Legal and safety. We may disclose information when we believe in good faith it is required to comply with law, legal process, or a government request; to enforce our agreements; or to protect the rights, property, or safety of Brackwell9, our users, or others.
- Business transfers. If Brackwell9 is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality protections.
- With your consent. We may share information for any other purpose disclosed to you with your consent.
4. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Inquiry messages are typically retained for up to 24 months. Engagement records are retained for the longer of seven years or the period required by applicable tax, accounting, or legal recordkeeping rules.
5. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
6. Your Rights and Choices
6.1 California residents (CCPA / CPRA)
If you are a California resident, you have the following rights regarding personal information we collect about you, subject to certain exceptions:
- Right to know what personal information we collect, use, disclose, and (if applicable) sell or share;
- Right to delete personal information we have collected from you;
- Right to correct inaccurate personal information;
- Right to opt out of the sale or sharing of personal information for cross-context behavioral advertising. We do not currently sell or share personal information in this manner;
- Right to limit the use and disclosure of sensitive personal information. We do not currently use or disclose sensitive personal information beyond purposes permitted without limitation under the CPRA; and
- Right to non-discrimination for exercising any of the rights above.
To exercise these rights, contact us using the information in Section 11. We will verify your request before responding, typically by confirming details associated with your records. You may designate an authorized agent to make a request on your behalf, subject to our verification of the agent’s authority.
6.2 Other jurisdictions
If you are located outside California, you may have similar rights under your local laws, including the right to access, correct, delete, or restrict processing of your personal information, and to object to processing or withdraw consent. Contact us to exercise these rights.
6.3 Marketing communications
You can opt out of marketing emails at any time by following the unsubscribe link in those messages or by contacting us. Transactional and service-related communications are not subject to opt-out.
6.4 Do Not Track
We do not currently respond to Do Not Track browser signals. As described above, the Site does not use tracking cookies or sell personal information.
7. Children
The Services are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided personal information to us, please contact us and we will delete it.
8. International Users
The Services are operated from the United States. If you access them from outside the United States, your information may be transferred to, stored, and processed in the United States and other jurisdictions where our service providers operate. By using the Services, you consent to such transfer.
9. Third-Party Sites
The Site may link to websites or services operated by third parties. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing personal information.
10. Changes to this Policy
We may update this Policy from time to time. When we do, we will revise the “Last updated” date above. Material changes will be communicated through the Site or by other reasonable means. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Policy.
